本服务条款协议（以下简称 “协议”）由您（以下简称 “客户” 或 “您”）与 5ssr Cloud（以下简称 “5ssr Cloud”、“我们” 或 “本公司”）签订。协议适用于您使用由 5ssr Cloud 提供的所有产品与服务，包括但不限于数据传输服务、云主机、服务器托管、网站托管、技术支持等服务（统称 “服务”）。在购买或使用任何服务前，请仔细阅读本协议。若您不同意本协议任何条款，请勿购买或使用本服务。
This Service Terms Agreement (“Agreement”) is entered into between you (“Customer” or “you”) and 5ssr Cloud (“5ssr Cloud,” “we,” or “us”). This Agreement governs your use of all products and services provided by 5ssr Cloud, including but not limited to data transmission services, cloud hosting, server hosting, website hosting, technical support, and other offerings (collectively, “Services”). Please read this Agreement carefully before purchasing or using any Services. If you do not agree to any terms, do not purchase or use the Services.

第一部分 术语定义
Section I — Definitions
1.1 服务提供方 / Service Provider
“5ssr Cloud” 是指 5ssr.com 网站的所有者及服务提供方，并负责向客户提供全部服务内容。
“5ssr Cloud” refers to the owner and provider of the 5ssr.com website and all Services provided to customers.
1.2 客户 / Customer
指注册、购买或以任何方式使用 5ssr Cloud 服务的自然人或法人实体。
“Customer” refers to any individual or entity that registers for, purchases, or otherwise uses the Services.
1.3 服务 / Services
指由 5ssr Cloud 提供的所有产品与服务，包括但不限于服务器、托管、数据传输等。
“Services” refers to all products and services provided by 5ssr Cloud, including servers, hosting, data transmission, and related offerings.
第二部分 协议接受
Section II — Acceptance of Terms
通过购买、注册或使用任何 5ssr Cloud 服务，即表示您已阅读、理解并同意受本协议全部条款约束。
By purchasing, registering for, or using any 5ssr Cloud service, you acknowledge that you have read, understood, and agree to be bound by all terms of this Agreement.
如果您不同意本协议任何条款，请勿使用或购买服务。
If you do not agree to any term in this Agreement, you must not use or purchase the Services.
第三部分 服务订购与确认
Section III — Service Ordering and Confirmation
3.1 在订购前，您可在 5ssr.com 查看所有可用服务计划。
3.1 Before ordering, you may view all available service packages on 5ssr.com.
3.2 您选择并提交服务订单即表示同意本协议适用于该服务。
3.2 Your selection and submission of a service order constitutes acceptance that this Agreement applies to such service.
3.3 在订单成功且付款到账后，我们将发送确认邮件。
3.3 Once the order is successful and payment is received, 5ssr Cloud will send a confirmation email.
3.4 5ssr Cloud 保留拒绝向任何客户提供服务的权利。
3.4 5ssr Cloud reserves the right to refuse to provide services to any customer.
3.5 即便提供正常运行时间保证，在紧急维护或例行维护期间，5ssr Cloud 仍可中断服务。
3.5 Even with uptime guarantees, 5ssr Cloud may interrupt service during emergency or scheduled maintenance.
3.6 客户可随时订购额外服务，此类服务同样适用本协议。
3.6 Customers may order additional services at any time, and such services are also governed by this Agreement.
第四部分 协议修改与通知
Section IV — Changes to Agreement and Notices
4.1 本协议构成适用于您购买的所有服务的完整条款与条件。
4.1 This Agreement constitutes the complete terms and conditions applicable to all Services you purchase.
4.2 5ssr Cloud 可随时修改本协议内容，包括费用、条款等。
4.2 5ssr Cloud may modify this Agreement at any time, including fees and terms.
4.3 我们将通过电子邮件、网站公告等方式通知客户更新内容。
4.3 5ssr Cloud will notify customers of updates via email, website notices, or other channels.
4.4 修改后的协议一经发布即刻生效，旧版本将不再具备法律效力。
4.4 The updated Agreement takes effect upon posting, and prior versions are no longer legally effective.
4.5 若您在更新后继续使用服务，即视为接受更新后的协议。
4.5 Continued use of the Services after updates constitutes acceptance of the updated Agreement.
第五部分 协议期限与取消政策
Section V — Term and Cancellation Policy
5.1 本协议自订单确认并收到合法付款时生效，服务期限按客户选择为准。
5.1 This Agreement becomes effective when the order is confirmed and payment is received, for the term you selected.
5.2 除非本公司违反协议，否则协议期间不会自动终止。
5.2 The Agreement does not terminate during the service term unless 5ssr Cloud materially breaches.
5.3 本公司可在任何时间以任何理由终止本协议并书面通知客户。
5.3 5ssr Cloud may terminate this Agreement at any time for any reason with written notice.
5.4 如果本公司根据本协议终止服务，所有已支付费用不予退款。
5.4 If 5ssr Cloud terminates under this Agreement, all prepaid fees are non‑refundable.
5.5 客户需在下一计费周期开始前取消服务以避免自动续费。
5.5 To avoid automatic renewal, the customer must cancel before the next billing cycle.
5.6 协议终止不免除客户支付所有已产生费用的义务。
5.6 Termination does not relieve the customer of the obligation to pay all accrued charges.
第六部分 服务终止原因
Section VI — Causes for Termination
6.1 在下列情况下，本公司可立即终止服务：
6.1 5ssr Cloud may terminate services immediately upon:
a) 客户违反可接受使用政策或本协议；
a) Customer’s violation of the Acceptable Use Policy or this Agreement;
b) 侵犯第三方合法权益；
b) Infringement of third‑party rights;
c) 不遵守适用法律法规；
c) Non‑compliance with applicable laws;
d) 上传或传播违法或高风险内容。
d) Uploading or distributing illegal or high‑risk content.
6.2 本公司可自行决定是否监控内容，但无义务执行。
6.2 5ssr Cloud may, at its discretion, monitor content, but is not obligated to do so.
第七部分 账户管理与安全
Section VII — Account Setup and Security
7.1 注册账户时，需提供真实有效的邮箱地址、用户名与密码，并对账户安全负责。
7.1 Upon registration, you must provide a valid email, username, and password and are responsible for account security.
7.2 所有通知将发送至所登记邮箱，请保持邮箱畅通。
7.2 All communications will be sent to the registered email; keep it active.
7.3 提供虚假或不准确的信息可能导致账户终止。
7.3 False or inaccurate information may result in account termination.
7.4 以下情形可导致账户访问被拒绝或终止：
7.4 The following may result in denied or terminated account access:
a) 不符合服务条件；
a) Not meeting service conditions;
b) 违反服务条款；
b) Violating service terms;
c) 根据数据判断可能存在违约风险。
c) Data indicating potential breach.
7.5 客户对账户下所有活动负全部责任。
7.5 Customers are responsible for all activity under their account.
第八部分 知识产权
Section VIII — Intellectual Property
8.1 客户在服务中使用的所有内容仍归客户所有。
8.1 All content you use in connection with the Services remains your property.
8.2 客户授予 5ssr Cloud 非排他性、免版税许可，以便提供及改进服务。
8.2 You grant 5ssr Cloud a worldwide, non‑exclusive, royalty‑free license to provide and improve the Services.
8.3 未经授权不得使用 5ssr Cloud 商标或徽标。
8.3 Use of 5ssr Cloud trademarks or logos without authorization is prohibited.
8.4 客户应对因内容使用或纠纷产生的费用负责。
8.4 You agree to bear costs arising from content use or disputes.
第九部分 可接受使用政策
Section IX — Acceptable Use Policy (AUP)
9.1 客户同意遵守网站公布的可接受使用政策，并定期检查更新。
9.1 You agree to comply with the posted Acceptable Use Policy and check for updates.
9.2 在法律允许范围内，本公司可监测使用情况并在必要时披露信息。
9.2 5ssr Cloud may monitor usage and disclose information as required.
9.3 客户不得利用服务从事违法或侵权活动。
9.3 You must not use the Services for illegal or infringing activity.
9.4 违反可接受使用政策可导致服务中断或终止。
9.4 Violations may result in service suspension or termination.
9.5 本公司对儿童性侵害内容采取零容忍政策，并按法律要求实施举报与处理。
9.5 Provisions related to zero tolerance and reporting obligations for child exploitation content.
9.6 若发现恶意或违规内容，应向 [email protected]
或提交客服工单举报。
9.6 Report suspected abusive content to [email protected]
or a support ticket.
第十部分 反垃圾邮件政策
Section X — Anti‑Spam Policy
10.1 在 5ssr Cloud 网络上发送垃圾邮件（SPAM）严禁。
10.1 Sending SPAM over 5ssr Cloud networks is strictly prohibited.
10.2 客户须遵守网站公布的反垃圾邮件政策。
10.2 You must comply with the posted anti‑spam policy.
10.3 违反者可能随时被终止服务。
10.3 Violators may have services terminated.
第十一部分 支付条款
Section XI — Payments
11.1 支付覆盖整个服务周期并受本协议约束。
11.1 Payments cover the service period and are subject to this Agreement.
11.2 除非另有约定，否则所有服务费均为预付且不可退款。
11.2 Unless otherwise agreed, all fees are prepaid and non‑refundable.
11.3 客户需在注册时选择支付方式，本公司可与第三方支付平台合作。
11.3 Customers must choose a payment method; 5ssr Cloud may use third‑party processors.
11.4 客户同意支付相关税费及因支付产生的额外费用。
11.4 You agree to pay all applicable taxes and payment‑related fees.
11.5 客户同意支付滞纳金及因收款产生的合理费用。
11.5 You agree to pay late fees and reasonable costs associated with collections.
11.6 服务开始后不接受退款请求。
11.6 No refunds after service commencement.
11.7 优惠券与优惠码的使用限制及滥用后果详见网站政策。
11.7 Restrictions and consequences for coupon and promo code abuse are detailed in posted policy.
第十二部分 数据备份与丢失
Section XII — Backups and Data Loss
12.1 客户负责自行维护数据安全与备份。
12.1 You are responsible for your own data security and backups.
12.2 5ssr Cloud 不保证可恢复全部丢失数据。
12.2 5ssr Cloud does not guarantee recovery of lost data.
12.3 如需额外备份服务，须另行书面约定。
12.3 Additional backup services require a separate written agreement.
第十三部分 资源使用与安全
Section XIII — Resource Usage and Security
13.1 客户不得进行逆向工程、反编译或其他破解行为。
13.1 You may not reverse engineer, decompile, or attempt to compromise systems.
13.2 客户不得进行未经授权的访问、干扰或引入恶意程序。
13.2 Unauthorized access, interference, or malware distribution is prohibited.
13.3 安全违规行为可能导致服务终止。
13.3 Security violations may lead to termination.
13.4 超量流量使用将依据公平使用政策处理。
13.4 Excessive bandwidth usage will be managed under fair use policy.
第十四部分 正常运行时间保证
Section XIV — Uptime Guarantee
14.1 5ssr Cloud 可根据服务等级协议（SLA）提供可用性保证。
14.1 5ssr Cloud may provide uptime guarantees under a Service Level Agreement.
14.2 额外 SLA 条款可通过书面约定加入。
14.2 Additional SLA terms may be incorporated by written agreement.
第十五部分 价格变更
Section XV — Pricing Changes
15.1 5ssr Cloud 有权修改价格及资源配置。
15.1 5ssr Cloud may change pricing and resource allocations.
15.2 价格变更不会影响当前已支付的服务周期。
15.2 Price changes do not affect current paid terms.
第十六部分 赔偿与责任限制
Section XVI — Indemnification and Limitation of Liability
16.1 客户同意赔偿 5ssr Cloud 及其关联方因客户使用服务引发的所有责任与费用。
16.1 You agree to indemnify 5ssr Cloud and affiliates for all liabilities and costs arising from your use.
16.2 客户保证其使用内容合法且不侵犯第三方权利。
16.2 You warrant that content and use comply with laws and do not infringe third‑party rights.
16.3 在法律允许范围内，对于因服务中断、数据丢失或其他损害造成的任何间接、特殊、惩罚性或衍生性损失，本公司不承担责任。
16.3 To the maximum extent permitted by law, in no event shall 5ssr Cloud be liable for any indirect, special, punitive, or consequential damages arising from service interruption, data loss, or other harm.
16.4 我们的累计责任限于客户在发生争议前 12 个月内实际支付的服务费用总额。
16.4 Our aggregate liability is limited to the total amount of service fees actually paid by the customer in the 12 months preceding the claim.
第十七部分 免责声明
Section XVII — Disclaimers
17.1 服务按“现状”提供，不作任何明示或默示保证。
17.1 Services are provided “as is,” without express or implied warranties.
17.2 本公司不保证服务无中断、无错误或满足客户所有需求。
17.2 5ssr Cloud does not guarantee uninterrupted, error‑free service or that services meet all customer requirements.
第十八部分 第三方服务
Section XVIII — Third‑Party Services
18.1 客户可能使用与服务无关的第三方产品/服务。
18.1 You may use third‑party products/services not part of 5ssr Cloud offerings.
18.2 第三方服务的风险和责任由客户自行承担。
18.2 You assume responsibility for third‑party services.
第十九部分 适用法律与争议解决
Section XIX — Governing Law and Dispute Resolution
19.1 本协议受可由双方协商确定的法律约束（如适用司法辖区）。
19.1 This Agreement is governed by the law of the mutually agreed jurisdiction.
19.2 双方因本协议产生的争议应首先通过友好协商解决；协商不成，可依法提起诉讼或仲裁。
19.2 Disputes should be resolved through good‑faith negotiation; failing that, legal action or arbitration may be pursued.
第二十部分 协议生效
Section XX — Agreement Execution
客户通过点击“同意”、提交订单或使用服务，即表示同意本协议全部条款并具有法律约束力。
By clicking “Agree,” submitting an order, or using the Services, you acknowledge and agree to all terms in this Agreement, which is legally binding.
